Paulina Galindo-Ochoa, Attorney at Law, is known for her expertise in real estate transactions in the Banderas Bay region, and a specialty in working with Punta Mita Properties. Paulina worked as the master developer’s on-site legal counsel and closing specialist from 2004 until February 2009, when she departed to open her own practice. During this time, Paulina oversaw the closing of over 200 property transactions totally over $400 million dollars, primarily purchased by non-residents of Mexico. Fully fluent in English, Paulina has a talent for guiding her clients through the purchase process in Mexico, and interacting with their home legal advisors. She is a graduate of Universidad Anáhuac del Norte, in Mexico City, where she received her law degree. Following her graduation in 1998, and prior to moving to Puerto Vallarta, she worked at the Mexico City District Attorney’s office, followed by a position at Santamarina y Steta, S.C., one of the largest and most respected law firms in Mexico’s Federal District. TITLE INSURANCE
Ensuring a clear and valid title to a property has been among the key concerns of a foreign buyer in Mexico. In recent years, the implementation of U.S. title insurance has become available, and Meridian Capital incorporated this into the purchase process for our clients, choosing to work exclusively with Stewart Title Guarantee de Mexico, S.A. de C.V., the most respected name in the business.
Title insurance is not required for cash purchases and many financed purchases, however we strongly recommend it, and have chosen to work with development projects, such as Punta Mita, where the issuance of Title Insurance is an automatic part of the property purchase process.
After a satisfactory title search has been conducted on the property and a clear chain of title established, a title commitment will be issued. In order for Stewart Title Guaranty de Mexico, S.A. de C.V. to issue a final title policy, they will require a copy of the fully recorded Public Deed, which contains the Preventive Notice and the Certificate of Liens, the title insurance premium paid in full, satisfaction of all conditions and terms contained in the title commitment and satisfaction of all other underwriting requirements.
Stewart’s title insurance policies are crafted to address the local title issues. Senior underwriters and local offices collaborate to deliver market-driven title protections addressing pertinent concerns.
Title insurance in Mexico works, as it does in the U.S. and Canada, to provide the buyer with a “contract of indemnity” that protects them against any loss due to a defective title. A one-time premium fee is paid at the time of the property closing for the policy, which then remains in effect until the owner sells the property and transfers title to a future buyer. The title company assumes the legal responsibility to defend the insured customer against claims, losses, or lawsuits filed against the titleholder, and the Title Insurance is the only monetary indemnification a buyer can obtain to guarantee ownership of real estate.

ESCROW
When purchasing property outside of the United States, one of the most important considerations for both a buyer and a seller is whether and under what conditions the transaction funds will be safely held and distributed by an independent party. Meridian Capital has selected Stewart International as their Escrow Agent of choice for their client’s transactions.
As in the U.S. and Canada, escrow services provide buyers with additional security in a real estate transaction, through the use of a reputable and independent third-party to hold transaction money until property rights have been legally transferred to the buyer. These funds are held in an individually numbered and insured escrow account with Stewart International until all matters and items required for closing are completed.
Once the Buyer has agreed to the terms of the escrow services agreement, an escrow file is opened. All funds are then deposited into Stewart’s Escrow Account and distributed according to the instructions provided. Payments can be made to third party providers to set up the Trust, obtain legal documents, order an appraisal, survey and title search.
